Establishment of an entrepreneurial agency, obtaining a temporary residence permit and a work permit for foreigners – Law Office Belgrade Knezevic
If you are a person of foreign citizenship who wants to set up an entrepreneurial business for the purpose of granting temporary residence on the basis of self-employment and obtaining a work permit in Serbia, this article is intended for you.
In addition to self-employment, the temporary residence permit and work permit can also be granted based on employment in Serbia and on the basis of being sent to work in Serbia, in which case the list of necessary documentation is slightly longer than that for self-employment.
It should be noted that for a stay of up to 90 days in Serbia, no special approval from the Ministry of Interior (MUP) is required, while for a stay longer than 90 days it is necessary to have one. Temporary residence may be granted for a period of one year, after which it may be extended for the same period.
Establishing an entrepreneurial agency
The establishment of an entrepreneurial activity is carried out before the Agency for Economic Registers (APR) and the procedure for establishing an entrepreneurial activity is carried out within a few days. From the documentation, it is necessary to submit a completed registration application, a photocopy of the passport, as well as proof of the paid fee, while after registration it is necessary to obtain a stamp.
Temporary residence permit
The request for approval of temporary residence is submitted to the Department for Foreigners of the Ministry of Internal Affairs of Serbia. If the request is submitted on the basis of self-employment, i.e. the following documentation must be submitted for the establishment of an entrepreneurial activity:
- completed application for a temporary residence permit
- copy of the passport (original to be submitted for review)
- excerpt from the BRA for the entrepreneurial agency
- proof of payment of fees
- copy of “white card”
- certificate of bank account turnover for the entrepreneurial agency
- confirmation of available funds on the account
- document regulating health insurance in Serbia
- two photos 30×40 mm
- business resume (CV)
Obtaining a work permit
Upon obtaining the temporary residence permit, a request for obtaining a work permit should be submitted to the National Employment Service (NES). If the request is submitted on the basis of self-employment, i.e. registered entrepreneurial agency, it is necessary to submit the following documentation:
- excerpt from the BRA for the entrepreneurial agency
- copy of the passport
- statement on the type, duration and scope of the entrepreneurial agency activity
- statement on available equipment for performing the activity
- foreigner’s degree with a certified translation by the official court interpreter
- lease contract for business premises
- proof of payment of fees
The entire procedure for issuing a work permit lasts several days and the permit is issued for the period for which temporary residence was granted.
